This Indenture made this this 8th day of April in the year of our Lord one thousand, eight hundred and eighty four, between Bryan Jarvis of the County of Davidson and State of North Carolina of the first part, and H.W. Fries of the County of Forsyth and State of North Carolina of the second part, witnesseth that the said party of the first part, in consideration of the purposes herinafter expressed and of the sum of one dollar, the receipt whereof is hereby acknowledged does by these presents, bargain sell convey unto the said party of the second part, his heirs and assigns the following described real estate situated in the County of Davidson, and State of North Carolina, bounded as follows, to wit: Adjoining the lands of Samuel Farabee's heirs, William Doty, near Clemmonsville, bounded on the North West by the public road which separates it from the lands of Samuel W. Farabee's heirs, on the North East by the lands of William Doty; on the South East by the old Henry Douthit place; and on the South West by the lands of Samuel Phelps and the old Phillip Hanes tract containing one Hundred and Twenty acres. The same being the land formerly belonging to Polly Hanes and sold by A. F. Hanes as Commissioner.

To have and to hold the same, with the appurtenances, unto the said party of the second part, his heirs and assigns forever.

And the said party of the first part does hereby covenant and agree with said party of the second part, his heirs and assigns, to warrant and defend the premises, aforesaid to the said party of the second part, his heirs executors, administrators and assigns, against the claims and entry of all persons whatsoever; and he doth further covenant that he is seized of said premises in fee simple, and has power to convey such an estate by this Indenture, and has done the same by these presents to the said party of the second part and his heirs, in trust, however, for the purposes and upon the conditions following; whereas the said Bryan Jarvis is justly indebted to H. W. Fries in the sum of $700, evidence by bond from date herewith due twelve months after date with interest from at 8 per cent per annum, and payable semiannually.

And whereas it the purpose of the conveyance secure the payment thereof. Now, therefore, if the said Jarvis shall well and truly pay the principal of indebtedness hereby secured on or before the 8 day AD 1884, with interest thereon at the rate of 8 per cent annum payable semiannually, according .....and effect of the said bond, then the contract shall be void and of none effect. But if the said Bryan Jarvis shall not pay the principal of the indebtedness hereby intended to be secured on or before the 8th April, 1884, or if the said Bryan Jarvis shall not pay the interest due thereon, at the time specified for the .....thereof, it is hereby provided and agreed, that the said H. W. Fires, Trustee as aforesaid his heirs..., administrators or assigns, shall enter upon the premises and take possession thereof, and then....advertise for thirty days at thru public places within the county of Davidson, and sell the same at public auction at the Court House door, in the town of Lexington upon such such terms as shall be proper.... of the moneys arisng from such sale the said H. W. Fries, Trustee, or his legal representatives shall ... principal and interest of the indebtedness here before mentioned to be secured, together with all legal ... reasonable changes in executing this trust, and ..., is any, shall be paid to the said Jarvis or his legal representatives. In witness whereof the party of the first part has hereunto set his hand the day and year first about written.
